Privacy notice for TK Elevator AGILE Mobile App

Our TK Elevator AGILE  Mobile App (hereinafter the “App”) enables you to call an elevator for dispatch to another floor of a building without touching the elevator system itself. The feature is available in buildings depending from the Owner of the building who offers the feature to passenger.

Responsibility for the processing of personal data

Below we would like to provide you with detailed information of how your personal data is processed when you download and use the TK Elevator AGILE Mobile App. The term “Personal data” means all data that can be used to personally identify you.

From a data subject’s perspective, the specific local TKE group company with whom the data subject is or has been in contact with, is to be regarded as the data controller of the respective data subject’s personal data.

At TKE, as an international business, most of our processes and services are interconnected and global and thus made available to (most) local TKE group companies by the German entities TK Elevator GmbH and/or TK Elevator Innovation & Operations GmbH. When it comes to such global processes, personal data is controlled jointly by the local TKE group company and one or both of the above-mentioned German entities.

First, please allow us to describe TKE’s understanding of data protection: data protection/data privacy is a matter of trust, and our user`s trust is central to our business. We respect your privacy and your personal data. Hence, we handle your personal data confidentially and in compliance with the applicable statutory data protection regulations.

In this document you will find details on how we use and process your personal data. We are certain that the information is easy to navigate and transparent. Collection of personal data when using TK Elevator AGILE Mobile App

If you would like to use our TK Elevator AGILE Mobile App, we collect the following data, which is technically necessary to operate the application and to ensure its stability and security (legal basis is Art. 6 para. 1 p. 1 lit. f GDPR):

- User-Account information

- IP address

- Date and time of the request

- Time zone difference to Greenwich Mean Time (GMT)

- browser

- Operating system and its interface

- Unique Device Identifier

- language and version of the browser software.

We delete logfile information after 90 days and your user-account information once you request to delete your user-account. If legal requirements request us we will  restrict the processing and comply with relevant retentuin and deletion requirements.

Registration and login

 

In order to be able to use TK Elevators AGILE Mobile App, you need to first create an account with us, where you are able to determine your personal login credentials that you need to be able to log into your personal account. For this registration and subsequent login procedure, we collect the following information about you:

 

·     Name and surname

·     E-Mail address

·     User name and password

·     Log file of your logins incl. date and timestamp

 

We process this personal data in order to provide you with an access to the services of our Application. Your data is deleted in case you deactivate your user account.

 

Rules Regarding Cookies

In addition to the aforementioned data, cookies are stored on your mobile device when you use our App. Cookies are small text files or blocks of data that are stored on the memory of your mobile device and which provide the party setting the cookie with certain information. Non-essential Cookies will only be used by our App, if you consent to their use via opt-in the cookie settings in our Cookie Policy.

Storage and storage period

The collected data is stored in the Microsoft Azure Cloud in the European data centres in the Netherlands and Ireland. More detailed information can be found at:

We delete the data accruing in this context after storage is no longer necessary or - in the case of statutory retention obligations - restrict processing.

 

Purposes and legal basis of processing

We process your data in compliance with the provisions of the EU-GDPR and all other applicable data protection laws. 

We primarily process personal data for the fulfilment of contractual obligations (Article 6 paragraph 1 lit. b GDPR): specifically for the purpose of initiating, executing or fulfilling a contract (the underlying contractual obligations here are contained in the “Terms of Use for the App”, once you have accepted them ). 

Furthermore, we process personal data in order to safeguard the following legitimate interests (Article 6 paragraph 1 lit. f GDPR):

In addition, we potentially process personal data for which we received explicit consent (Article 6 paragraph 1 lit. a GDPR). We will collect that data separately.

Who receives your data ?

Your data will be processed within the TK Elevator Group by the employees involved in the initiation/implementation and operation of the provided service and execution of the respective business processes.

Within our group of companies your data will be transmitted to certain companies when they perform centralized data processing tasks for the group’s affiliated companies (e.g. centralized contact data management, centralized contract management, file disposal).

In addition, in order to fulfill our contractual and legal obligations, we sometimes use different external service providers who are required by data processing agreements to observe data protection laws, Article 4 No. 8 GDPR.

Finally, we may be using different external service providers, for instance analysis (see more directly below).

We are also including certain third-party services. When you use such third-party services or when third-party content is displayed, communication data are exchanged between you and the respective provider for technical reasons.

The respective provider of the services or content may also process your data for own additional purposes. To the best of our knowledge, we have configured the services and content of providers known to process personal data for own purposes in such a way that either any communication for other purposes than to present their services or content on our App is blocked, or communication only takes place once you have actively opted to use the respective service. However, since we have no control over data collected and processed by third parties, we are not in a position to provide binding information regarding the scope and purpose of such processing of your personal data.

Your rights

You have the following rights with regard to your personal data (Art. 15ff GDPR):

- right to information,

You also have the right to complain to a data protection supervisory authority about our processing of your personal data (Art 77 GDPR). You can find the relevant European supervisory authority at the website of the Federal German Commissioner for data protection and freedom of information.

 

Right to object

For reasons relating to your particular situation, you have the right to file an objection at any time to the processing of personal data pertaining to you that is collected under Art 6 Clause (1e) GDPR (data processing in the public interest) or Art 6 Clause 1 f) GDPR (data processing on the basis of a balance of interests). If you file an objection, we will continue to process your personal data only if we can document mandatory, legitimate reasons that outweigh your interests, rights and freedoms, or if processing is for the assertion, exercise or defense of legal claims. To the extent we use your personal data for direct marketing based on legitimate interests, you have the right to object at any time without giving reasons.
